  1. By browsing, surfing or using this site, you represent that you have read, understand and unconditionally agree to comply with and continue to comply with the Terms of Use (hereinafter referred to as “Terms of Use”).  We, “K” Line Air Travel Limited (hereinafter referred to as “KTL”) reserves the right to amend the Terms of Use from time to time and KTL may not send out immediate notice.  You can review the most updated version of the Terms of Use anytime at www.klinetravel.com or www.klinetravel.com.hk .

In addition to the Terms of Use, there are other governing terms and conditions applicable to certain products and services.  The terms and conditions for certain product(s) or service(s) shall include any terms and conditions found on your screens and when using any part of this site.  You are required to read the terms and conditions for such product(s) or service(s).  If there is any inconsistency between the terms and conditions for products or services and the Terms of Use, the former shall prevail in relation to that products or services.

KTL has the ownership and copyright of this site.  All the data, content and materials found on this site belong to KTL or are owned by its affiliates, third party providers and/or distributors.  The trademarks, logos and service marks shown on this site are registered trademarks of KTL, its affiliates, third party providers and/or distributors.  You are not allowed to alter, modify, translate or create any derivative works from any content, data, materials, trademarks, logos and service marks from this site.

  4. By browsing, surfing or using this site, you agree that you:-

    (a) shall use this site to make legal and legitimate bookings, reservations or purchases and shall not use this site for any other purposes, including but not limited to, make any false or fraudulent bookings, reservations or purchases;

    (b) shall not use false or misleading email address(es) and shall not provide or submit any false information to KTL;

    (c) shall register and provide or submit information or data as required in this site from time to time.  You shall have a user ID and password upon successful registration.  KTL reserves the right to suspend or terminate your account and refuse your access to and use of this site if KTL reasonably suspects that the information or data provided by you is untrue, inaccurate, not current or incomplete; 

    (d) shall be solely and fully responsible for keeping confidential of your account information, user ID and the password;  

    (e) shall immediately notify KTL of any unauthorized use of your account or password or any other breach of security;

    (f) shall ensure that you logout from your account  after browsing, surfing or using this site;

    (g) shall be solely and fully responsible for all activities that occur under your account or password;

    (h) are of sufficient legal age to use this site and to create binding legal obligations for any liability you may incur as a result of the use of this site;

    (i) shall be financially responsible for all uses of this site by you and those using your login information;

    (j) Without the prior written approval of KTL, shall not copy, upload, post, transfer, transmit, distribute, reproduce or otherwise communicate to the public any of the content or data provided in this site, including but not limited to the text, graphics, audio and video clips, data compilations and software save and except that you are only allowed to print the booking, reservation or purchase web page for your own personal and non-commercial use;

    (k) Without the prior written permission of KTL, shall not take any action, use any "spider", program or device to monitor or copy any data, content or material found on this site

    (l) shall not take any action, use any device, software or routine to interfere with the operation of this site;

    (m) shall not transfer, transmit, distribute or post any information which :-

         (i) contains viruses or any harmful components;

         (ii) is defamatory, indecent, threatening, pornographic or any material which KTL considers as reasonably inappropriate;

         (iii) or violates or infringes others’ rights, copyright, trademarks, other intellectual property rights or privacy.

    (n) shall be liable and indemnify KTL for any damages or losses suffered by KTL, its affiliates, third party providers and distributors if you violate or infringe others’ rights, copyright, trademarks, other intellectual property proprietary rights or privacy.

By browsing and/ or using this site, you agree to our collection and use of your personal information and/ or data as described in this Privacy Policy.  If we change our privacy policies and procedures, we will post those changes on this site to keep you aware of what information we collect, how we use it and under what circumstances we may disclose it.

We take the privacy of your personal information and/ or data seriously and ensure that your privacy is protected in accordance with Personal Data (Privacy) Ordinance of Hong Kong.  When you visit this site, we will collect from you the following personal information and/or data (including but not limited to), which you knowingly disclose, provide or submit to us:-

Processing bookings, reservations, purchases of our services or products, billing and payment.

Processing your application or registration for our services, enquiry or feedback.

Incorporation into our user database.

(d)

Provision of contacts and business details in response to enquiries and complaints.

(e)

Operations.

(f)

Service surveys.

(g)

Direct marketing.

(h)

Meeting requirements to make disclosure under any law applicable in or outside Hong Kong.

We may use your personal information/ data both in and outside Hong Kong.

  1. We limit our employees’ access to the aforesaid personal information and/ or data. Our employees designated to handle the aforesaid personal information and/ or data will be instructed to access the same according to Personal Data (Privacy) Ordinance of Hong Kong.

 

  1. Under the Personal Data (Privacy) Ordinance of Hong Kong and subject to our right to charge a reasonable fee for processing any data access request, you have the right:-

To check whether we have personal information and/ or data about you and to access such personal information and/ or data;

To require us to correct any inaccurate personal information and/or data relating to you; and

(c)

To be told our personal information and/or data policies and practices and the kind of personal information and/ or data held by us.

  1. If it becomes necessary that we take legal action against you, you agree that the personal information and/or data provided by you can be relied upon in identifying and taking action against you.

 

  1. We retain personal information and/ or data so long as such personal information and or data is still required for the aforesaid purposes.  We reserve the right to retain copies indefinitely for our archives.

This site may contain links to other websites.  When you use a link to go from this site to any other websites, our Privacy Policy is no longer in effect.  Your browsing and/or use of any other websites, including websites that have a link to this site, is subject to that website's own terms and conditions which may differ from that of this site.  We are not responsible for the practices employed by websites linked to or from this site nor the information or content contained therein.

You further agree and consent to the use and processing of your personal information and/ or data by KTL, its third party providers and distributors in accordance with the Personal Data (Privacy) Ordinance.  You agree that the technical processing of this site and the transmission of transaction information relating to the products and services on this site may involve (a) transmissions of your personal information and/ or data collected by us over various networks and to various countries; and (b) changes to conform and adapt your personal information and/ or data collected by us to technical requirements of connecting networks or devices.  We shall not be held liable for events arising from third parties having unauthorized access to such information and/ or data.


    Online Bookings​

  2. KTL acts as agents for its third party providers and distributors for all products and services purchased by you on this site.  When you place bookings or reservations for or purchase products and services online on this site, our staff will contact you by email and phone within the next 2 working days to confirm the bookings or purchases.  However, if your bookings, reservations or purchases are not made on a working day or is made on a working day of which the succeeding day is not a business day, our staff will contact you by email and phone within the next 2 working days after the end of the day which is not a business day to confirm the bookings, reservations or purchases.

 

  1. You understand that KTL processes your bookings, reservations or purchases during normal office hours.  KTL needs at least 2 working days before confirming your bookings, reservations or purchases.  KTL will not be held liable for any loss, damages or compensation if you book or purchase a product or service that cannot be fulfilled between the time of booking or reservation and the time of departure.  In such an event, KTL shall refund to you all unutilised monies collected from you for that purchase, booking or reservation.

 

  1. You are solely responsible to make sure that the booking, reservation and/ or purchase made contains the correct and requisite information before proceeding to payment.  KTL, third party providers and distributors shall rely on the information provided by you and shall not be responsible for any errors or mistakes made in your booking, reservation and/ or purchase.

 

  1. You are not allowed to make multiple over-lapping bookings and/ or reservations for the same traveller(s) and you shall be solely responsible for all the losses and damages suffered by KTL, third party providers and distributors because of your breach of this clause.

    Definition of Working Day
  1. The word “working day” wherever used in the Terms of Use shall mean calendar days from Mondays to Fridays only PROVIDED that when any of the working day shall fall on a day on which a day which is not a business day (defined as a day on which licensed banks are opened for business in Hong Kong) or shall fall on a day on which typhoon signal No.8 or above is hoisted or black rainstorm warning signal is issued in Hong Kong at any time during the business hours which shall be 9:00 a.m. to 5:00 p.m. such working day shall automatically be postponed to the next business day or such next succeeding day on which no typhoon signal No.8 or above is hoisted or black rainstorm warning signal is issued (as the case may be).

    Valid and Binding Contract
     
  2. Despite Clause 18 above, a contract for the sale and purchase of such products and services will be made online on this site by your acceptance of the products and services offered on the site (hereinafter referred to as  "Contract") by KTL, third party providers and/or distributors.  You shall not challenge the validity or enforceability of Contracts entered into on this site.  By indicating your acceptance to purchase any products or services offered on the site, you have to complete such transactions.  By submitting an order to purchase products or services, you represent and warrant that you have the legal right to purchase, utilise and/or possess such products or services.

  3. You shall be solely and fully responsible for making sure that your travel documentation is valid, with at least six months validity remaining and conforms to the laws and visa requirements of your destination.  You agree to be fully liable to KTL, third party providers and distributors for the full cost and handling fees for any products and services booked but cancelled for any reason at your request.

  4. You understand, agree and accept that the travel service providers for whom KTL acts as an agent may impose terms and conditions including conditions of carriage, refund and cancellation policies of airlines, cruise lines, car hire operators, hotels, tour operators, car hire companies, insurance companies, and other entities (hereinafter referred to as “Third Party Providers and Distributors”). You agree to be bound by such terms and conditions.  

    Overbooking and Change of Flight Times
     
  5. KTL is not responsible for any incidents like overbooking or rescheduling of flights times by Third Party Providers and Distributors. 

    Non-Fulfilment or Unsatisfactory Fulfilment
     
  6. KTL is also not liable for any claims for non-fulfilment or unsatisfactory fulfilment of products and services by Third Party Providers and Distributors.

    Prices
     
  7. All prices of your bookings, reservations or purchases may be changed until full payment is received and are subject to Third Party Providers and Distributors’ availability.  A booking fee may be payable on some bookings or reservations.  Some airport taxes are not pre-paid and you must pay these when required.  Some airlines or travel service providers may charge fuel surcharges which may not be reflected in the prices shown.  For travel services such as air tickets, hotels, cars, packages or cruises-availability, prices, fare conditions and class of travel can be changed at any time by the Third Party Providers and Distributors without notice.  Other special conditions may be imposed by the Third Party Providers and Distributors.  
     
  8. Unless otherwise expressly stated, all prices on this site shall be exclusive of all taxes, levies, fees, airport pick up charges and all other charges together with any fine, penalty or interest payable because of your default.  You must pay any amount you are required to pay under this clause in full on demand.

    Cancellation of or Changes to Bookings, Reservations and Purchases
     
  9. Please note that cancellation of or changes to bookings, reservations and/or purchases, at your request, is subject to the specific terms and conditions applicable to specific products or services.  Cancellation of or changes to bookings, reservations and/or purchases may be subject to respective cancellation or changes fees which you agree to bear in full.

    Disclaimer

You understand and agree that KTL provides this site on “as is” basis.  KTL shall not be responsible for the accuracy, completeness, currency or reliability of any of the content, data or material found on this site.  KTL expressly disclaims all warranties, terms and conditions of merchantability, satisfactory quality, fitness for a general or particular purpose and non-infringement of proprietary rights.  KTL does not warrant that this site or any email sent from KTL are free of viruses or other harmful items.  KTL shall not be responsible for any loss or damage arising from your failure to comply with the Term of Use and other terms and conditions applicable to the products or services.

 

  1. KTL reserves the right without prior notice to suspend all or part of this site to carry out maintenance, repair, update work or other work KTL deems necessary.

You agree to indemnify and hold KTL and its subsidiaries, affiliates, officers, agents, employees, partners and licensors harmless from any claim or demand, including reasonable legal costs, made by any third party due to or arising out of your use of this site or your violation of any rights of others.

KTL may at any time modify any part of the site, including the products and services, the Terms of Use, and the terms and conditions for products and services at its sole discretion without prior notice.  Your continued use of this site will be subject to the terms and conditions in force at the time of your use.  KTL reserves the right to deny any person access and use of this site at any time.

Additional terms and conditions may apply to bookings, reservations, purchases of products and services and other uses of portions of this site, and you agree to be bound abide by such other terms and conditions, including additional terms and conditions that apply in relation to specific products and services.

    Severability
     
  6. In the event any clause herein is found not to be legally enforceable, such unenforceability shall not prevent the enforcement of any other clauses.

    Headings
     
  7. The headings used in the Terms of Use are included for convenience only and will not affect the terms and conditions herein.

    Entire Agreement
     
  8. The Terms of Use and any terms and conditions incorporated herein or referred to herein constitute the entire agreement between KTL relating to the subject matter hereof, and supersedes any prior understandings or agreements (whether oral or written) regarding the subject matter, and shall not be amended or modified except in writing or by making amendments or modifications by KTL on this site.

    Termination
     
  9. KTL may terminate the Terms of Use and/or the terms and conditions of any products and services at any time for any reason.  Such termination shall not affect any right to relief to which KTL may be entitled.  Upon termination of the Terms of Use, all rights granted to you will be terminated and be reverted to KTL, Third Party Providers and Distributors, as applicable.

    Governing Law and Jurisdiction

    42.   The Terms of Use and your relationship with KTL shall be governed by and interpreted according to the laws of Hong Kong Special Administrative Region (hereinafter referred to as “Hong Kong”).  You agree to submit to the non-exclusive jurisdiction of the Courts of Hong Kong.

    43.   In the event of any inconsistency between the English and Chinese version of the Terms of Use, the English version shall prevail.
